https://www.nikolaidis.eu is the online store for the exhibition and sale of products via the internet of the company ΝΙΚΟΛΑΪΔΗΣ Γ. ΙΩΑΝΝΗΣ, located Ηράκλειο Κρήτης (VAT number: 065133759/Δ.Ο.Υ ΗΡΑΚΛΕΙΟΥ) and which will be referred to as the “Company” for the sake of brevity for the purposes of this document. Entering, browsing and using https://www.nikolaidis.eu implies your express and unconditional consent, acquiescence and agreement to the following terms. The “Company” operates an online store through which it is possible to sell agricultural products and various other items at a distance. The use by any visitor of the website https://www.nikolaidis.eu is governed by the entire present terms of use. The visitor of the “Website” has the opportunity, based on the specific terms of use of the website https://www.nikolaidis.eu, to purchase products, which the “Company” sells through the steps described in detail below in the relevant paragraph of the terms of sale. The “Company” declares to each visitor of https://www.nikolaidis.eu that under no circumstances does the promotion of its products through https://www.nikolaidis.eu and its operation in its entirety constitute a proposal by the “Company” to each visitor for the conclusion of a sales contract for any of the products and/or all of them.

The “Company” undertakes to make every effort to ensure to the Users the truth, accuracy and completeness of the information provided on its electronic website, regarding the identity and details of both the “Company” and its partners, as well as the main or essential characteristics of the services available through the website. The “Company” reserves and is not bound for any technical or typographical errors made inadvertently during common experience or after incorrect indication of a cooperating company or due to reasons of force majeure or due to an outage of the website and which it agrees to correct if they come to its attention.

2.Intellectual property

The website https://www.nikolaidis.eu and its content (including texts, graphics, images, pictures, photographs, designs, products,  logos, distinctive marks and software) are the intellectual property of the “Company” or third parties contracted with the “Company” and are protected by Greek, Community and international laws on trademarks and industrial and intellectual property as well as the presentation of the above on the website https://www.nikolaidis.eu under no circumstances should be construed as a transfer or assignment of a license or right to use them. The reproduction, re-publication, uploading, communication, dissemination or transmission or any other use of the content of the website https://www.nikolaidis.eu in any way or means for commercial or other purposes is permitted only with the prior written permission of the “Company” or any other legal copyright holder.

Each User / visitor is obliged, agrees and undertakes to use the services, information and data of our electronic website as provided by law and based on the rules of good faith and trade morals. – sending, posting, publishing, e-mailing or otherwise transmitting any content that infringes any patent, trademark, trade secret, copyright or other proprietary rights of the “Company” or third parties.

– sending, posting, publishing, e-mailing or otherwise transmitting any material that contains software viruses or any other code, files or programs designed to interrupt, damage, destroy or equip the operation of any software or computer hardware.

– violation of applicable laws or regulations, whether intentional or not.

– harassment of third parties in any way.

– collection or storage of personal data about other users.

 

Any use contrary to the above, apart from any civil liability, will result in the termination of the services provided without any notice.

 

4.Limitation of liability

 

The “Company” shall not be liable for any legal or civil and/or criminal claims or for any damage (positive, special or consequential which, indicatively and not restrictively, disjunctively and/or cumulatively, consists of loss of profits, data, lost profits, monetary compensation, etc. ) by visitors to the website or third parties for reasons related to the operation or not and/or the use of the website and/or the inability to provide services and/or information available from the website and/or any unauthorized interference by third parties in products and/or services and/or information available through the website …………

The “Company” is not responsible for any technical problems that may occur to users when they attempt to access the website or during their visit to it and are related to the operation or compatibility of their own infrastructure with the use of the website or a technical problem of the Internet provider. It also does not guarantee that its website or any other related site or the servers through which they are made available to visitors – members, do not contain “viruses” or other harmful programs.

The “Company” does not provide any guarantee for the availability of the products contained in the website https://www.nikolaidis.eu but undertakes to inform customers as soon as possible about the unavailability in case they are interested in purchasing a product that is not available.

The “Company” is not liable to customers for any damages that may arise from the execution or not of their order.  It also reserves the right to the time of delivery of the products in cases of force majeure.

The “Company” points out to users / customers that the images, photographs, and/or drawings available through the website https://www.nikolaidis.eu and concerning / presenting products and services, are not a faithful representation of colors, designs and dimensions and may differ from the actual product. The “Company” reserves the right to change, add, remove in any way the content of the website https://www.nikolaidis.eu without notice.

 

5.”Links” to other websites

Where our website contains links to third party websites, the “Company” is not responsible for the content of these pages and for any damage or harm that may arise from their use, as the visitor has access to them exclusively by his/her own choice and responsibility. In particular, the “Company” is not obliged to check the availability, the content, the personal data protection policy, the quality and completeness of the services of other websites and websites to which it refers through “hyperlinks” or advertising messages (banners). Therefore, for any problem that may arise during their use, the User should address directly to the respective websites and webpages, who are responsible for the provision of their services. The provision of any links on the website is for the convenience of the User and the “Company” in no way approves, does not accept and is not responsible for the content of any link.

6.Order

  1. A) Via online order by following the next steps:

The “Company” fully complies with the provisions of Greek Law, and in particular with the provisions of Law 2251/1994 on Consumer Protection, as applicable. The use of the e-shop by minors or persons lacking legal capacity is prohibited, for whose access to the site the “Company” is not responsible.

You do not need to create an account to use or make purchases from https://www.nikolaidis.eu. If you choose to create an account you will be asked for the following information:

  • Name
  • Surname
  • Email
  • Fixed or mobile phone
  • Address details
  • Login code

The above data are not publicly displayed. Only your name is displayed when you log in with the password that only you know. By providing the above information you can easily make your online purchases without having to fill out the order form every time. You can also track the progress of your order as well as the history of all your orders. The completion of the order takes place with the unconditional acceptance of these Terms of Use and the Final Submission of the order. Upon completion of your order you will be sent an e-mail confirming receipt of your order and its number, followed by a subsequent e-mail, which will inform you of the dispatch of your order.

If you request an invoice, you will be asked for the invoicing and shipping details of the products you purchase. The invoicing details are used to issue the invoice, which are not stored. To enable us to process your order, we share the shipping details with the transport company where your products will be delivered to you. If you choose to pay by card, your card details are not stored by …………, as they are entered in the payment form of the partner bank.

 

  1. B) By email, by sending a message to info@nikolaidis.eu or by following the relevant application on the website under the contact option, where you fill in the corresponding form. Following your message we will contact you personally through any appropriate means in order to achieve the best and fastest possible service.

 

7.Changes – Returns – Product Replacement

 

In all cases where you wish to return or replace the product you have purchased, you must inform us within fourteen (14) days of receipt (Law.2251/1994). at info@nikolaidis.eu informing us of the reason for the return or replacement, filling in the contact phone number and the order number. A partner from the transport company will then contact you to collect the return parcel. Alternatively you can contact us at +30 2810 326292. The cost of returning the product in any case is borne by the customer.

 

Terms of returns :

1.The product must not have been used.

  1. The return must be made within fourteen (14) calendar days.

3.The product must be accompanied by the original proof of purchase (Retail receipt, invoice, delivery note-invoice, etc.).

  1. It must be in the condition received by the customer, complete and undamaged, and its packaging must be that which normally accompanies the product.
  2. Returns are not accepted on products that we bring to the store on order.

You have the right to return the product you have purchased, exercising the right of withdrawal and – only if the product has not been used – to request a refund of the price you have paid to us, within 14 days from the date indicated on the purchase receipt. To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by a clear statement (see the Withdrawal Form).

Refunds are available for purchases made with cash on delivery, credit card or Paypal. The refund process will be completed no later than 30 days from the date of receipt of the products and if they are in perfect condition, to the account indicated by the customer. (see the Cancellation  Form).

For any order cancellation before shipping and courier delivery you must contact us by phone at +30 2810 326292 quoting your Order Number.

The “Company” is not responsible for any loss or damage of the product during the return transport.

In case you find a defect you must contact our online store immediately after delivery on the same day or the next working day at +30 2810 326292.

If the products are returned damaged, the “Company” has the right to claim compensation from the customer, the amount of which will be determined by the condition of the products, and to unilaterally make a partial set-off of its claim against the customer’s claim.

 

8.Payment methods

 

8.1.Credit cards

All credit cards accepted, VISA , MASTERCARD..

Using your credit card for your purchases in the online store is completely safe, provided you follow the relevant instructions. Once you have completed the completion of all the details required to place the order, you will be automatically transferred to the secure site of the partner bank (Eurobank) where you will be able to fill in your credit card details directly. To pay by credit card, you will need to fill in the relevant form with the exact name of the holder, the number and expiry date of your credit card, as well as the three-digit number (CVV) on the back of the card. The check and payment is instant, if you are connected to the partner bank (Eurobank).

In each case of purchase, the buyer must also be the holder of the card used for the transaction.

 

8.2.Pay On Delivery

The customer pays the courier company’s employee, who acts on behalf of the “Company”, upon delivery of the order at his premises. In this case the customer will be charged with the costs of cash on delivery 5 Euro (including VAT 24%, for all purchases). Cash on delivery is valid only for deliveries within Greece.

 

 

 

8.3.PAYPAL

Once you complete the completion of all the remaining data required for the registration of the order, you will be automatically transferred to the secure site of Paypal, from where you will be able to either fill in your credit card details directly or register (login) to your existing Paypal account and use your stored data.

Our goal is to deliver your order in the shortest possible time, simplifying the shipping process, The “Company” cooperates with the courier ACS and transportation company ΛΑΤΩ & ΕΛΕΜ ΦΑΡΟΣ.

Delivery of Products

Within 3 to 4 working days for mainland Greece, Crete and islands (we always refer to delivery to the capitals of the prefectures and not to remote areas), if the products you have ordered are available. The above deadlines do not apply during periods of bad weather, strikes and in any case of force majeure that may affect delivery times.

In the event that a product is not immediately available, you will be informed in a timely manner by the order department of the estimated delivery time.

For any dispute that may arise between the “Company” and users from the use of the e-shop, an effort will be made to resolve it amicably after a written request by the user. If the dispute can not be resolved out of court, the Courts of Heraklion, Crete, are competent.

The “Company” reserves the right to unilaterally amend or renew these terms and conditions of transactions made through the website https://www.nikolaidis.eu  without prior notice, informing visitors by posting the new terms and conditions on this website.
